最高法回应裁判文书审判员隐名

Recently, the Supreme People’s Court of China responded to public concerns regarding the anonymization of judges’ names in court judgments. Addressing cases where the names of presiding judges are omitted from published rulings, the Court explained that this practice primarily aims to protect judges’ personal safety and ensure an undisturbed working environment, especially in sensitive, high-profile, or socially contentious cases. The Supreme Court emphasized that anonymization is not a blanket policy but a carefully considered measure applied on a case-by-case basis in accordance with relevant judicial interpretations and internal regulations. Meanwhile, China continues to advance judicial transparency, including through the comprehensive publication of effective judgments on the China Judgments Online platform to safeguard public access and oversight rights. The Court also noted its ongoing efforts to strike a better balance between protecting judicial personnel and promoting openness, with continuous improvements to institutional mechanisms to enhance judicial credibility.

近日,最高人民法院就社会关注的‘裁判文书审判员隐名’问题作出回应。针对部分裁判文书中未公开承办法官姓名的情况,最高法表示,此举主要出于对法官人身安全和正常履职环境的保护考虑,尤其是在涉及敏感、重大或社会关注度高的案件中。最高法强调,隐名并非普遍做法,而是根据案件具体情况依法审慎决定,并严格遵循相关司法解释和内部规定。同时,法院系统正持续推进司法公开透明,包括通过中国裁判文书网全面公开已生效的裁判文书,以保障公众知情权与监督权。最高法还指出,未来将在确保法官职业安全与推进司法公开之间寻求更合理的平衡,不断完善相关制度机制,提升司法公信力。
