Recently, China has officially incorporated unauthorized drone operations—commonly known as ‘black flying’—into its legal framework, marking a new phase in the management of low-altitude airspace safety. ‘Black flying’ refers to operating drones without approval, failing to file required flight plans, or flying in prohibited zones. Such activities not only disrupt air traffic order but also pose risks to civil aviation, public safety, and even critical national infrastructure.Under the newly revised Interim Regulations on the Management of Unmanned Aircraft System Operations and related laws, all individuals and organizations must complete real-name registration before using a drone and submit flight plans via official platforms prior to operation. Unauthorized flights near airports, military zones, government buildings, or other sensitive areas may result in warnings, fines, or even criminal liability. In severe cases, offenders could be charged with crimes such as endangering public safety. The new legislation strengthens oversight across the entire drone lifecycle—from manufacturing and sales to operation—with clear regulatory standards. It also encourages the adoption of technical solutions like geofencing and remote identification systems to enhance enforcement efficiency. This move not only safeguards public security but also fosters a healthy environment for the compliant development of the drone industry.Experts emphasize that as the low-altitude economy rapidly expands, a robust legal framework is essential for ensuring orderly operations and sustainable industrial growth. The public is urged to heighten legal awareness and voluntarily comply with flight regulations to jointly maintain safety and order in low-altitude airspace.
