Recently, a case involving a housekeeper and an elderly person’s bequest of property has drawn public attention. The court ruled that although the elderly individual had made a will bequeathing their property to the housekeeper who had cared for them for years, the bequest was invalid because the housekeeper failed to fulfill statutory support obligations. According to China’s Civil Code, a legacy-support agreement is valid only if the beneficiary actually provides care. If the legatee fails to offer necessary daily care, emotional support, or financial assistance to the testator, they are not entitled to the bequest. In this case, the court found that although the housekeeper nominally provided care, she had consistently neglected the elderly person and even engaged in abusive behavior—seriously violating the basic requirements of support duties. Consequently, despite the existence of a written will, the court declared the bequest invalid, and the property will be distributed according to statutory inheritance rules. This ruling underscores the principle of ‘rights correlating with obligations,’ reminding the public that a bequest cannot be based solely on one-sided intent—it must rest on a genuine, sustained, and effective caregiving relationship.
