Recently, online claims that ‘insulting someone resulting in serious injury or death carries a maximum sentence of three years’ have drawn public attention. In fact, this statement is misleading. Under China’s Criminal Law, verbal abuse alone typically falls under administrative penalties governed by the Public Security Administration Punishments Law, usually resulting in warnings, fines, or short-term detention. However, if the abusive language constitutes severe defamation or insult, it may amount to criminal offenses under Article 246 of the Criminal Code, punishable by up to three years of imprisonment, criminal detention, public surveillance, or deprivation of political rights.Importantly, if verbal abuse directly triggers a medical emergency (e.g., a heart attack) leading to serious injury or death, courts will assess causation and the offender’s intent or negligence. If the offender knowingly targeted someone with a known health condition and used extreme verbal provocation, they could be charged with negligent infliction of serious bodily harm or negligent homicide under Articles 233 or 235 of the Criminal Code—offenses carrying a maximum penalty of up to seven years’ imprisonment. Therefore, the ‘three-year maximum’ applies only to specific defamation or insult cases, not all incidents where verbal abuse leads to injury or death. The public should communicate respectfully and avoid verbal aggression to prevent legal consequences.
