Recently, a local court in China sentenced 12 individuals to probation for sharing obscene videos in online chat groups and ordered the confiscation of their mobile phones used in the offense. According to Article 364 of China’s Criminal Law, the crime of disseminating obscene materials—whether for profit or not—involves distributing obscene publications, films, audio-visual content, images, or other indecent materials under circumstances deemed ‘serious.’ In this case, although some defendants claimed they merely ‘forwarded casually’ or ‘did not profit,’ the court ruled their actions constituted the crime due to the wide reach and group-based nature of the distribution, qualifying as ‘serious circumstances.’ Considering their cooperation, expressions of remorse, and lack of prior criminal records, the court granted suspended sentences while confiscating the devices used to commit the offense. This ruling underscores judicial efforts to maintain a clean and lawful online environment and serves as a warning: even non-commercial sharing of obscene content online can lead to criminal liability. Users should not assume casual forwarding is harmless or legal.
