Recently, China’s State Administration for Market Regulation officially released the ‘Measures for the Supervision and Administration of Food Contract Manufacturing,’ which will take effect on October 1, 2024. The Measures aim to further standardize food contract manufacturing practices, clarify the primary responsibilities of both the commissioning party and the contract manufacturer, strengthen oversight throughout the entire production process, and ensure food safety.According to the Measures, the commissioning party is designated as the primary responsible entity for food quality and safety. It must rigorously verify the contract manufacturer’s production qualifications, quality management systems, and actual production capabilities, and is accountable for the accuracy of product labels and instructions. The contract manufacturer, in turn, must strictly comply with laws, regulations, and contractual agreements during production, refrain from unilaterally altering formulas or processes, and maintain complete production records for inspection.Furthermore, the Measures require both parties to sign a written agreement specifying their respective rights and obligations and to report contract manufacturing information to local market regulation authorities. Regulatory bodies will enhance mid- and post-production supervision through credit-based oversight and unannounced inspections, imposing strict penalties for any violations.The introduction of these Measures helps clarify responsibility boundaries in contract manufacturing, promotes industry-wide compliance, and effectively safeguards consumers’ food safety.
近日，国家市场监督管理总局正式发布《食品委托生产监督管理办法》，自2024年10月1日起施行。该《办法》旨在进一步规范食品委托生产行为，明确委托方与受托方的主体责任，强化全过程监管，保障食品安全。《办法》明确规定，委托方作为食品质量安全的第一责任人，必须对受托方的生产资质、质量管理体系和实际生产能力进行严格审核，并对产品标签、说明书的真实性负责。受托方则须严格按照法律法规和委托合同组织生产，不得擅自更改配方或工艺，并需保存完整的生产记录以备查验。此外，《办法》还要求委托双方签订书面协议，明确各自的权利义务，并向所在地市场监管部门报告委托生产信息。监管部门将通过信用监管、飞行检查等方式加强事中事后监管，对违法违规行为依法严肃处理。该《办法》的出台，有助于厘清委托生产中的责任边界，提升行业整体合规水平，切实守护消费者‘舌尖上的安全’。
