市监总局禁止大型企业拖欠中小企账款

Recently, China’s State Administration for Market Regulation (SAMR) issued new regulations explicitly prohibiting large enterprises from leveraging their market dominance to delay payments to small and medium-sized enterprises (SMEs). This measure aims to improve the business environment, protect the legitimate rights of SMEs, and promote fair transactions across supply chains. Under the rules, large enterprises must pay for goods or services within the timeframes stipulated in contracts and are barred from unjustifiably delaying payments, imposing unfair price reductions, or attaching unreasonable conditions. Enterprises that violate these provisions may face regulatory actions such as official warnings, public disclosure, credit penalties, or administrative fines. This policy reinforces the implementation of the ‘Regulations on Ensuring Payment of Accounts Receivable to SMEs’ and addresses real-world challenges faced by SMEs—such as difficulties in financing and slow cash recovery—thereby boosting their operational confidence and vitality. It also contributes to building a more trustworthy, transparent, and efficient market order, supporting high-quality economic development.

近日,国家市场监督管理总局发布新规,明确禁止大型企业利用市场优势地位拖欠中小企业账款。该举措旨在优化营商环境,保障中小企业合法权益,促进产业链上下游公平交易。根据规定,大型企业应在合同约定的期限内及时支付货款或服务费用,不得以任何理由无故拖延、压价或附加不合理条件。对于违反规定的大型企业,监管部门将依法采取约谈、通报、信用惩戒乃至行政处罚等措施。此举是对《保障中小企业款项支付条例》的进一步落实,有助于缓解中小企业融资难、回款慢等现实困境,增强其经营信心与活力。同时,也有利于构建更加诚信、透明、高效的市场秩序,推动经济高质量发展。
