Hong Kong’s Immigration Department recently disclosed that it investigated 531 suspected sham marriage cases in 2023, resulting in the arrest of 710 individuals. Sham marriages refer to fraudulent unions entered into for the purpose of obtaining residency rights, One-way Permits, or other immigration benefits, thereby undermining the integrity of Hong Kong’s immigration control system. According to official reports, many of these cases involved organized intermediaries who charged substantial fees to pair local residents with mainland Chinese nationals for the sole purpose of facilitating applications for settlement in Hong Kong. Such activities not only violate the Immigration Ordinance but may also constitute criminal offenses such as conspiracy to defraud. The department emphasized its ongoing commitment to enhancing intelligence gathering, inter-agency collaboration, and the use of advanced technology to combat sham marriages and related illegal schemes. Convicted offenders face a maximum penalty of 14 years’ imprisonment. Authorities also urged the public not to engage in such unlawful acts and encouraged reporting suspicious activities to help uphold a lawful and orderly immigration system.
