Such extreme overloading not only causes severe damage to road infrastructure but also significantly increases the risk of catastrophic accidents—including brake failure, tire blowouts, and rollovers—posing a grave threat to public safety.Under China’s Criminal Law and relevant judicial interpretations, dangerous driving includes operating school buses or passenger transport vehicles with severe overcapacity, speeding excessively, or transporting hazardous chemicals in violation of safety regulations—any of which endanger public safety. In recent years, judicial practice has increasingly extended this provision to cover cases of grossly overloaded freight transport. The criminal prosecution of these “100-ton king” drivers signals a shift from administrative penalties to criminal liability in enforcement against overloading, reflecting a “zero-tolerance” stance.This move aims to strengthen legal accountability, deter illegal transportation practices, promote compliance within the freight industry, and safeguard public safety and road traffic order.
