2名“百吨王”驾驶员被刑事立案

In recent years, judicial practice has increasingly extended this provision to cover cases of grossly overloaded freight transport. The criminal prosecution of these “100-ton king” drivers signals a shift from administrative penalties to criminal liability in enforcement against overloading, reflecting a “zero-tolerance” stance.This move aims to strengthen legal accountability, deter illegal transportation practices, promote compliance within the freight industry, and safeguard public safety and road traffic order.

近日,两名驾驶严重超载货车(俗称“百吨王”)的司机因涉嫌危险驾驶罪被公安机关依法刑事立案。所谓“百吨王”,是指总质量远超国家法定限值(通常为49吨)的重型货运车辆,部分车辆实际载重甚至高达100吨以上。此类超载行为不仅严重破坏公路基础设施,还极易引发刹车失灵、爆胎、侧翻等重大交通事故,对公共安全构成极大威胁。根据《中华人民共和国刑法》及相关司法解释,从事校车业务或旅客运输、严重超过额定乘员载客,或严重超过规定时速行驶,以及违反危险化学品安全管理规定运输危险化学品,危及公共安全的,可构成危险驾驶罪。近年来,司法实践逐步将严重超载的货运行为纳入该罪名适用范围。此次对“百吨王”驾驶员刑事立案,标志着执法部门对超限超载治理从行政处罚向刑事追责升级,体现了“零容忍”态度。此举旨在通过强化法律责任,震慑违法运输行为,推动货运行业合规运营,保障人民群众生命财产安全和道路交通秩序。
