人社部:推动修订职工带薪年休假条例

Recently, China’s Ministry of Human Resources and Social Security (MOHRSS) announced it will actively promote the revision of the ‘Regulations on Paid Annual Leave for Employees,’ aiming to further strengthen the protection of workers’ leave rights. Since its implementation in 2008, the current regulation has played a positive role in safeguarding employees’ basic vacation entitlements. However, with evolving socio-economic conditions and increasingly diverse employment arrangements, certain provisions have become outdated and insufficient to address current realities. For instance, many enterprises—especially small and medium-sized businesses—often fail to fully implement the paid leave policy, leaving employees reluctant or unable to take their entitled vacations.The proposed revision will focus on enhancing employer accountability, clarifying implementation standards, establishing clear penalties for non-compliance, and exploring ways to extend annual leave protections to gig workers and other non-traditional labor groups. The MOHRSS emphasized that extensive research and public consultation will be conducted to ensure the updated regulations are both practical and effective, thereby genuinely improving workers’ well-being and satisfaction.Strengthening the enforcement of paid annual leave not only supports employees’ physical and mental health but also stimulates consumption and domestic demand, contributing to high-quality economic and social development. With these improvements and stronger enforcement, workers across China can look forward to more equitable and accessible access to their statutory paid vacation rights.
