12人向微信好友转发淫秽视频获刑

Judicial authorities stress that cyberspace is not beyond the reach of the law, and citizens must abide by legal regulations when using social media, refraining from forwarding unverified or illegal content. These rulings aim to raise public awareness of legal responsibilities and promote responsible online conduct to foster a healthier digital environment.

近日,中国多地法院陆续宣判多起因在微信等社交平台传播淫秽视频而获刑的案件。其中一起典型案例涉及12名被告,他们因向微信好友转发含有淫秽内容的视频,被认定构成传播淫秽物品罪,分别被判处有期徒刑或拘役,并处罚金。根据《中华人民共和国刑法》第三百六十四条,传播淫秽物品罪是指以牟利或非牟利为目的,传播淫秽书刊、影片、音像、图片或其他淫秽物品,情节严重的行为。值得注意的是,即使未从中获利,只要传播行为达到一定数量或造成不良社会影响,也可能构成犯罪。司法机关强调,网络空间不是法外之地,公民在使用社交软件时应遵守法律法规,不得随意转发未经核实或含有违法不良信息的内容。此类判决旨在警示公众提高法律意识,规范网络行为,共同维护清朗的网络环境。
