Recently, China’s Ministry of Commerce announced the initiation of a countervailing duty investigation into dairy products originating from the European Union. It has preliminarily determined that subsidies exist and decided to impose provisional countervailing measures. This move aims to safeguard a fair competitive environment for China’s domestic dairy industry and prevent material injury caused by unfairly low-priced imports resulting from foreign government subsidies.According to the investigation, certain EU member states have provided their dairy producers with financial support, tax incentives, or price supports, granting these products an unfair pricing advantage in the Chinese market. In accordance with China’s Anti-Subsidy Regulations, the Ministry of Commerce has lawfully imposed provisional countervailing duties following its preliminary findings.The measures apply to a range of dairy products, including milk powder, cheese, and butter, with duty rates set individually based on each exporting company’s circumstances. Provisional measures typically remain in effect for no more than four months. If the final ruling confirms the existence of subsidies and resultant injury, definitive countervailing duties could be imposed for up to five years.This action reflects China’s commitment to upholding industrial security and enforcing trade rules within the framework of the World Trade Organization (WTO). China emphasizes that such countervailing measures are not protectionist but a necessary response to unfair trade practices, helping ensure that China-EU economic relations develop on a fair and mutually beneficial basis.
