The newly revised Foreign Trade Law of the People’s Republic of China will come into effect on March 1, 2024. This revision aims to further optimize the foreign trade business environment and enhance China’s institutional opening-up within the global trading system. Key updates include: strengthening support for fair trade by explicitly prohibiting discriminatory measures and ensuring equal participation for all market entities in international trade; improving trade remedy mechanisms to better protect domestic industries; incorporating provisions on emerging areas such as digital and green trade to align with evolving global trade norms; and streamlining foreign trade registration procedures to advance ‘streamlining administration, delegating power, and improving regulation and services’ (the ‘Fang Guan Fu’ reform), thereby reducing institutional transaction costs for businesses. Additionally, the revised law enhances intellectual property protection and encourages the development of small and medium-sized enterprises (SMEs) and cross-border e-commerce. This amendment reflects China’s commitment to high-standard openness and active participation in global economic governance, creating a more stable, transparent, and predictable legal environment for foreign trade enterprises and supporting the new development paradigm of dual circulation—domestic and international—anchored by a robust domestic economy.
