In recent years, as electric vehicles (EVs) become increasingly common, some residential property management companies have banned owners from driving EVs into underground parking garages—often citing reasons like ‘fire safety concerns’ or ‘insufficient electrical capacity’—and even refused to allow the installation of charging stations. However, according to relevant Chinese laws and policy documents, property management does not have the authority to unilaterally prohibit EVs from entering underground garages.In 2020, China’s National Development and Reform Commission (NDRC) and three other ministries jointly issued the ‘Notice on Accelerating the Construction of EV Charging Infrastructure in Residential Communities,’ which clearly states that property management must cooperate with homeowners or charging facility providers and must not obstruct the installation of charging equipment. Additionally, China’s Civil Code affirms that homeowners have the right to use their exclusive property, and property managers cannot arbitrarily restrict lawful vehicle access or usage.If an underground garage meets basic fire safety and electrical standards, the property should assist residents in installing charging points rather than imposing blanket bans. Where genuine safety or capacity issues exist, solutions should involve professional assessments and infrastructure upgrades—not outright refusal.Therefore, if faced with such unreasonable restrictions, homeowners may file complaints with local housing authorities, neighborhood offices, or consumer associations, and may also seek legal remedies when necessary. Promoting green transportation requires collaboration among property managers, residents, and government—not artificial barriers.
