Starting next year, two specific groups of individuals in China may face administrative detention for illegal acts—even if their actions do not constitute criminal offenses—under newly revised regulations. According to the updated Public Security Administration Punishments Law and related provisions, these two groups primarily include: (1) individuals who repeatedly commit minor violations and refuse to reform despite repeated warnings; and (2) those who use online platforms to disrupt social order or spread false information.Previously, law enforcement typically issued warnings or fines for minor infractions. However, as societal governance demands have increased, repeated and deliberate disruptions of public order by certain individuals have caused significant negative impacts. The new rules now stipulate that anyone committing three or more public security violations within a year and refusing to correct their behavior may be subject to administrative detention. Additionally, online misconduct—such as fabricating and spreading rumors, inciting social division, or maliciously sensationalizing sensitive incidents—may result in 5 to 15 days of administrative detention, even if it falls short of criminal prosecution thresholds.These measures aim to strengthen legal deterrence and safeguard social fairness, justice, and a healthy online environment. Experts urge the public—especially youth and active internet users—to enhance legal awareness and avoid seemingly minor violations that could lead to serious consequences and affect future opportunities.
