万亿商业航天知识产权谁说了算

As the commercial space industry enters a ‘trillion-dollar’ era, intellectual property (IP) ownership has become a critical issue. In traditional state-led aerospace models, technological outputs were typically owned by governments. Today, however, private companies—such as SpaceX, Blue Origin, and Chinese firms like i-Space and GalaxySpace—are deeply involved in rocket launches, satellite manufacturing, and operations. Questions arise over how to define, protect, and trade their self-developed technologies and data assets. Legal frameworks globally remain underdeveloped, especially regarding orbital resources, Earth observation data, and inter-satellite communication protocols. In China, laws including the Civil Code, Patent Law, and the draft Space Act are gradually establishing an IP governance structure, emphasizing the principle of ‘who invests, who owns, who benefits.’ However, mechanisms for IP sharing in cross-border collaborations and international partnerships still require clarification. Moving forward, creating clear, predictable, and internationally compatible IP rules will be essential to incentivize innovation and ensure the sustainable growth of the commercial space sector.

随着商业航天产业迈入‘万亿级’新阶段,知识产权(IP)归属问题日益成为行业焦点。在政府主导的传统航天模式下,技术成果多归国家所有;而如今,越来越多的民营企业如SpaceX、蓝色起源以及中国的星际荣耀、银河航天等深度参与火箭发射、卫星制造与运营,其自主研发的技术和数据资产如何确权、保护与交易,成为关键议题。目前,各国法律体系对商业航天IP的规定尚不完善,尤其在轨道资源、遥感数据、星间通信协议等新兴领域存在模糊地带。在中国,《民法典》《专利法》及《航天法(草案)》正逐步构建相关制度框架,强调‘谁投资、谁拥有、谁受益’原则,但跨域协作、国际合作中的IP共享机制仍需进一步明确。未来,建立清晰、可预期、国际兼容的商业航天知识产权规则,将是保障创新激励、促进产业健康发展的核心基础。
