Recently, consumers reported that in a local restaurant, the tea service fee in the non-smoking area was twice as high as that in regular seating areas, sparking public concerns over pricing fairness. In response, the local Market Supervision Administration stated that as long as businesses clearly display prices and do not force customers to pay, they are allowed to set their own prices based on factors such as service environment and operational costs—this falls under market-driven pricing. However, if restaurants fail to inform customers in advance or steer them into higher-priced zones without consent, it may infringe upon consumers’ rights to information and choice. The administration emphasized that establishing non-smoking zones aligns with national tobacco control policies and supports public health—a practice worthy of encouragement. Nevertheless, using ‘non-smoking’ as a pretext to significantly raise fees without transparent communication or voluntary customer agreement could lead to disputes. Authorities advise diners to inquire about pricing details before being seated and to keep receipts for potential complaints. They also urge restaurants to balance service differentiation with fairness and integrity, genuinely enhancing customer experience rather than simply adding hidden charges.
